1. Definitions and Parties

"Evora Health" ("we", "us", "our") refers to the business operating under the trade name Evora Health, based in South Africa.

"Website" refers to www.evorahealth.co.za and all related subdomains.

"Products" refers to the Evora Smart Band, Evora Smart Pod, Evora LED Therapy Mask, any bundles thereof, and any other physical or digital products offered for sale.

"Community" refers to the Evora Health community platform, newsletter, social media channels, and member-facing content.

"User" ("you", "your") refers to any person who visits this Website, purchases Products, or participates in the Community.

"Consumer" refers to a natural person purchasing Products for personal, household, or family use as defined under the Consumer Protection Act 68 of 2008.

2. Acceptance of Terms

By accessing this Website, purchasing any Product, or participating in the Community, you agree to be bound by these Terms & Conditions in their entirety. If you do not agree, you must not use this Website or purchase any Products.

These Terms constitute a legally binding agreement between you and Evora Health under the laws of the Republic of South Africa.

3. Products and Services

All Products sold by Evora Health are wellness devices and are not medical devices, diagnostic instruments, or therapeutic tools as defined under applicable South African health legislation. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Product specifications, descriptions, and imagery are provided for informational purposes. While we make every effort to ensure accuracy, minor variations may exist between product descriptions and actual products. Such variations do not constitute a material defect.

Evora Health reserves the right to modify, discontinue, or replace Products at any time without prior notice, subject to honouring orders already placed and paid for.

4. Pricing and Payment

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices are subject to change without notice. The price applicable to your order is the price displayed at the time you complete checkout.

Payment is processed securely through PayFast, a South African payment gateway. Evora Health does not store or have access to your card or banking details. By completing a purchase, you also agree to PayFast's terms and conditions.

Orders are confirmed only upon successful payment. An order confirmation email will be sent to the email address provided at checkout.

5. Delivery and Shipping

Evora Health currently delivers within the Republic of South Africa only. Estimated delivery times are 2-5 business days from order confirmation, subject to courier availability and location.

Free delivery applies to orders exceeding R 2,000. Orders below this threshold may attract a delivery fee, which will be displayed at checkout.

Risk of loss and title for Products pass to you upon delivery to the address provided. Evora Health is not liable for delays caused by courier services, incorrect addresses provided by the customer, or circumstances beyond our reasonable control (force majeure).

If a delivery is unsuccessful due to an incorrect or inaccessible address, redelivery fees may apply.

6. Returns, Refunds and Exchanges

Summary: You have 7 days to return an undamaged, unused Product for a full refund. Defective products are covered under our 12-month warranty. Please read the full terms below.

6.1 Change of Mind Returns

You may return a Product within 7 calendar days of receipt for a full refund, provided:

  • The Product is unused, in its original packaging, with all accessories and documentation included.
  • The Product has not been activated or paired with an account.
  • You have contacted us at admin@evorahealth.co.za to initiate the return before sending the Product back.

Return shipping costs for change-of-mind returns are borne by the customer. Refunds will be processed within 10 business days of receiving the returned Product in satisfactory condition.

6.2 Defective Products

If a Product arrives damaged or develops a manufacturing defect within the warranty period, please contact us at admin@evorahealth.co.za with photographs and a description of the defect. We will arrange collection and replacement or refund at our cost.

6.3 Non-Returnable Items

Products that have been activated, customised, or used (beyond initial inspection) cannot be returned for change-of-mind reasons. Digital content, subscriptions, and downloadable materials are non-refundable once accessed.

7. Warranty

All Evora Health Products carry a 12-month limited warranty against manufacturing defects from the date of purchase, valid within South Africa.

The warranty does not cover damage caused by misuse, accidents, unauthorised modification, water damage (beyond stated IP ratings), or normal wear and tear.

To make a warranty claim, contact admin@evorahealth.co.za with proof of purchase and a description of the issue. We reserve the right to assess the product before authorising a warranty claim.

8. Health and Medical Disclaimer

Important: Evora Health Products are wellness devices, not medical devices. The information and metrics provided by our Products and Platform are for personal wellness monitoring only.

The health data, insights, and information provided through Evora Health Products and the Website do not constitute medical advice, diagnosis, or treatment. You should not use our Products as a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician, healthcare provider, or other qualified health professional with any questions you may have regarding a medical condition or health objective.

The Evora LED Therapy Mask uses photobiomodulation technology. Individuals with photosensitivity conditions, certain skin conditions, or those taking photosensitising medications should consult a healthcare professional before use.

Evora Health accepts no liability for any health consequences arising from reliance on data or insights provided by our Products or Platform.

9. Intellectual Property

All content on this Website, including text, images, graphics, logos, design, software, trademarks, and the Evora Health brand, is the intellectual property of Evora Health or its licensors and is protected under South African and international intellectual property law.

You may not reproduce, copy, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content from this Website without prior written consent from Evora Health.

10. User Conduct and Community

By participating in the Evora Health community, you agree not to:

  • Post content that is defamatory, abusive, harassing, threatening, or discriminatory.
  • Share false, misleading, or fraudulent information.
  • Infringe the intellectual property rights of Evora Health or any third party.
  • Attempt to gain unauthorised access to any part of our systems or platforms.
  • Use our platform for commercial solicitation without prior written consent.

Evora Health reserves the right to remove any content or suspend any account that violates these terms, without notice.

11. Limitation of Liability

To the maximum extent permitted by South African law, Evora Health's total liability to you for any claim arising from these Terms or your use of our Products or Website shall not exceed the amount you paid for the specific Product giving rise to the claim.

Evora Health shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our Products, Website, or Community.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded under the Consumer Protection Act or any other applicable South African legislation.

12. Privacy and POPIA

Evora Health processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). The manner in which we collect, use, store, and protect your personal information is set out in our Privacy Policy, which forms part of these Terms by reference.

By using this Website or purchasing Products, you consent to the processing of your personal information as described in our Privacy Policy.

13. Consumer Protection Act (CPA)

To the extent that you are a consumer as defined under the Consumer Protection Act 68 of 2008 (CPA), nothing in these Terms shall limit, restrict, or override any right you have under the CPA. In any conflict between these Terms and the CPA, the CPA shall prevail.

Your rights under the CPA include, but are not limited to, the right to fair and honest dealing, the right to quality goods, the right to safe and good-quality products, and the right to return defective goods.

14. Electronic Communications

In accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECTA), by providing your email address you consent to receiving electronic communications from Evora Health, including order confirmations, community updates, and marketing communications. You may opt out of marketing communications at any time by clicking "unsubscribe" in any email or by contacting us at admin@evorahealth.co.za.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.

In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If resolution cannot be reached within 30 days, either party may refer the matter to the applicable consumer tribunal or court of competent jurisdiction in South Africa.

16. Amendments

Evora Health reserves the right to amend these Terms at any time. Amended Terms will be published on this page with an updated effective date. Continued use of the Website or Products after the effective date of any amendment constitutes acceptance of the revised Terms.

We will notify registered community members of material changes to these Terms via email where reasonably practicable.
